新临时父母签证

澳洲助理移民部长Alex Hawke于五月四日向SBS新闻公布了两种将推出的新临时父母签证

两个新的临时父母签证包括
1)$5,000澳元为期3年签证和
2)$10,000澳元为期5年签证

根据新计划,申请人可以申请5,000澳元三年签证或10,000澳元五年有效期之签证,有机会以同一价格续签另外五年,因此10年期之临时父母签证费用将为20,000澳元。

其他详情:
-每年15,000个配额
-不允许工作
– 需要购买私人健康保险
– 儿子女赞助人必须是澳大利亚公民或永久居民或“符合条件”的新西兰公民
– 不允许在10年以后再重新申请
– 不会有永久居留权的途径
新计划之临时父母签证将有助于政府限制医疗费用上涨。 Mr Hawke也同时表示说,这个新计划可以让祖父母到澳洲去照顾他们的孙子,让父母可继续工作

457签证

*现时已递交的任何457签证之雇主赞助及提名若不在新的STSOL或MLTSSL职业名单中, 该457签证申请将不会被批准。申请费用可以退还。

*从2017年4月19日起,任何新的457申请必须是在STSOL或MLTSSL职业名单上职业。

*如果您在2017年4月18日之后获得457签证,如果职业是在STSOL上, 则只能获得两年签证,之后可以再续延另外2年,但您将不能申请永居186/187签证。

*如果您在2017年4月18日之后获得457签证,如果职业是在MLTSSL名单上, 便可获得4年的457签证。如果该公司决定提名您,您将能够在3年后申请永居186/187签证。

*从2018年3月起,新的TSS签证将取代457签证。在申请前,您需要有最少2年之工作经验,您的职业必须在STSOL或MLTSSL名单上。如果您的职业在STSOL列表中,您必须显示您只想暂时留在澳大利亚。

*从2018年3月起,若您申请公司/雇主资助的(一步到位)永久居留186/187签证, 申请的职业必须是在MLTSSL职业名单上,您还需要承诺为该公司工作3年,与雅思成绩高于6分,而年龄在45岁以下。

未来457变化时间表:

*从2017年4月19日起,有216个职业被除去,其中59个被加上限制,24个职业限制于澳大利亚指定地区,职业名单名称更改, 在STSOL上的职业只会批准为期2年的签证。

*从2017年7月1日起 – 工资达$96,400澳元的英文水平豁免条件将会癈除,加强雇主对培训基金贡献的遵守,及强制性申请人提供无犯罪纪录证明。

未来186/187变更时间表:

189独立技术移民签证

您只能提名 “Medium and Long-term Strategic Skills List (MLTSSL)” 职业名单上的职业。如果您在MLTSSL职业名单上找不到您要提名的职业,您将无法申请此签证。

190技能提名签证

您可以提名MLTSSL或 “Short-term Skilled Occupation List (STSOL)”或州省政府职业名单上的职业。但是,某些职业限制了申请人申请190签证,如Project Builder, Chemical Engineer, Production Manager等40个职业已经施加了这一限制。除此之外,州省政府已经宣布将修改其技能提名名单,以回应这些变化,即将有进一步消息公布。

关于废除457签证的压倒性消息今天在互联网和论坛上疯传。非457签证的申请人认为他们是安全的。今天下午,移民部公布了进一步信息,有关改变不仅影响到457签证申请人,还影响到190,489,186, 407以及剩余期限457签证申请人,因为SOL和CSOL技术移民清单将由2017年四月十九日开始由新的职业名单取代,名为中长期战略技能名单(MLTSSL)和短期技能职业名单(STSOL),部门称名单将每6个月更新一次。

例如:233111化学工程师只能申请189,485和489签证,190签证将不可使用。

457临时(技能)签证将被废除

总理马尔科姆·特恩布尔(Malcolm Turnbull)说:「联邦政府将废除457签证,取而代之为两项新签证」。

目前的457签证持有人不会受到这些变化的影响,将引入的两项新的临时技术签证为 – 两年签证和更专业的四年“针对更高的技能” 签证。 特恩布尔先生表示,新制度将明确以“国家利益”为严谨,坚决地进行。

他评论现时的457签证计划是开放式的,因此持有人最终可以留在澳大利亚,因此联邦政府将提出新的临时技能签证而此是短期签证,目标是暂时提供缺乏之技能,分别是两年的签证,及再延期两年签证,但最终持有人不会获得永久居留权。

境内伴侣签证SC820/801的处理时间显著增加至16-23个月。优先处理低风险申请人之申请

移民局局长-伴侣签证 致信关于增加境内伴侣签证的处理时间。由于伴侣签证申请率高﹑境内申请管道增加﹑此签证有较高的欺诈活动以及该部门的资源限制等原因,大部份的临时伴侣和永久伴侣签证的平均处理时间目前为由SC820提交之日起或由SC801 / 100提交之日起计算增至16至23个月。该信件亦透露,他们将优先处理低风险申请人,及已提交了完整文件, 能马上付合批获该签证之申请。因此,该局现在不会坚持按照递交申请之先后时间顺序方法去处理申请。这个安排将导致一些后期呈交申请人却较其他之前申请人优先获得批获签证。

进一步限制在签证申请中 包括成年的家庭成员在内

您是否知道由2016年11月19日开始, 新修订的澳洲移民法例 已进一步限制达到23岁的成年家庭成员加入签证申请中?

法例更改前,主要申请人可以在其签证申请中 包括他们的子女或亲戚在内 包括18岁以上﹑未婚﹑同住及完全或基本上依赖主要申请人所提供的财政支持为生。简单说,任何年龄超过18岁,甚至50岁者只要付合以上要求的子女或法订亲戚也可以包括在签证申请内。

法例更改后, 任何子女达到23岁或以上,甚至未曾结婚并且完全或基本上依赖主要申请人的财政支持为生的,也不能包括在主要申请人的签证申请内,除非该子女是因为精神或实际身体残障而无法工作而且只可以依赖申请人的财政支持为生(别无他人可依赖),。 因此,子女以外的其他亲属,甚至一直在财务上依赖于主申请人者已不能再包括在签证申请内了。除非是依赖子女之依赖子女例外, 即主申请人的孙子女。但其父或母及他们自己也同时必须符合以上的年龄限制要求。

这些新修订限制了一些 以往可透过他们合资格移民澳洲的亲属一同移民澳洲的人。同时, 申请人亦需要考虑在移民时, 一些成年倚赖子女无法一起移民。

十年有效访问签证

澳大利亚移民和边境保护局已正式通过十年有效访问签证子类, 这项修订创建了一个新的子类600(访客)签证流,称为”频繁旅者”, 允许常访旅游或商务访客活动,并允许长达10年的有效期。

申请人打算访问澳大利亚的原因是:
(a)作为旅游者;要么
(b)从事商务访问活动。

此签证费为$1,000澳元。

签证将允许访客多次进入澳大利亚,每次进入后可逗留3个月。访客不得在每24个月内逗留超过12个月。

访客必须接受医疗评估。

此签证流暂时只适用于中国公民

最新颁布:关于技术移民,在澳大行利亚完成博士或硕士学位(研究生)申请人能获得额外五分

澳大行利亚移民和边境保护局刚公布新修订的一般技术移民“点考”制度,一般技术移民(GSM)的申请人除可以从现时的教育程度及澳大行利亚学习两方面获取分数之外,若他们同时在澳大行利亚完成博士或硕士学位(研究生)可以额外获取 5分,如果符合以下要求。

1)已完成至少两个全学年的博士或硕士(研究)级研究生学位,并
2)在指定的毕业范畴,其中包括科学﹑科技﹑工程,数学或信息及通信技术。

根据这项新措施,被接受的指定学习范畴包括以下

– 化学科学

澳大利亚工程师协会 – 中国签署华盛顿协议
现在中国工程师要做澳大利亚移民时之技能评估更加容易。

澳大利亚工程师协会宣布,中国-由中国科协科技(CAST )代表, 于2016年6月2日,成为华盛顿协议全签署。

在2016年或之后完成的中国认可资格的持有人将有资格成为澳大利亚工程师协会成员以及通过认证资格之途径作移民技能评估。

虽然CAST是华盛顿协议的签署,但合资格的课程必须是获得中国工程教育协会(隶属机构)网站上认可的课程名单,。

对于可被华盛顿协议认可的资格,必须是在认可名单上列出的资格,并在2016年或之后完成。

澳大利亚护士和助产士认证委员会(ANMAC)宣布由2016年7月1日起,技能评估对英语语言要求有所变更。

变化将接受和允许多个英语测试结果以作为技能评估要求。

由2016年7月1日起将接受以下的英语测试:

雅思(学术类)
ANMAC将接受在同一个测试或最多两个测试结果,必须在六个月期间进行。

在同一个测试内,最低总体得分为7分

在测试中的任何部份没有得分低于6.5

OET
ANMAC将接受在同一个测试或最多两个测试结果,必须在六个月期间进行。

接受PTE学术英语 – 2016年7月1日生效
申请人必须达到最低总体得分65和每个个何部包括听力,阅读,写作和口语最低分数为65 – 。

从2016年7月1日起, 新的简化学生签证框架将会启动

从以上日期开始, 新的学生签证框架将会开始,到时有只有两个学生签证类别,即子类500(学生)和子类590(学生家长)。

新的的学生签证框架将删除并取代目前的学生签证子类别570,571,572,573,574, 575, 576 和580。

此举变化之目的是按照澳大利亚政府于2015年6月16日公布的未来发展方向中的流畅签证处理报告,并宣布推出一个简化学生签证框架(SSVF),以支持澳大利亚教育服务部门发展。在SSVF下主要的变化是:
•减少学生签证类别, 由八类减至只有两类;和
•为所有国际学生引进简化的单一移民风险框架。

单一移民风险框架, 将被使用于指导学生在申请学生签证时, 要提供的财政能力和学生英语语言能力的证据。

北澳 更新州提名技术移民职业清单, 欢迎更多的技术移民

最近 北澳大利亚Northern Territory更新了州提名职业列表, 63项新职业已经加入提名职业列表上, 为今年七月开始推出的北澳$50亿基础设施项目贷款计划提前作预备。 联邦政府已经准备好推出澳大利亚北部基础设施((NAIF))来管理其$50亿贷款计划,以刺激北部地区的发展。北澳政府为此已经优先开放了其职业技能列表, 增加职业技能要求的数量。州政府将赞助永久州提名技术移民(子类190)和临时州提名技术移民(子类489)之签证,总共超过170种职业。

对于已经居住于北澳及持有以下签证的人,可以申请州提名技术移民:

工作假期(子类417)和(子类462)签证持有者
– 已经持有签证不少于六个月,及
– 已居住于北澳和全职工作于相关的职业技能最少三个月, 同时在受聘期间是受薪市场应有薪金,及
– 可以显示能继续就业的前景,及
– 签证获批后, 打算真正居住和工作在北澳不少于两年。

临时技术工作457签证持有者
– 已经在当地生活及为赞助顾主工作不少于六个月。特殊情况除外。
– 必须有457赞助顾主的函件, 支持其员工的签证申请,以及顾主他们明白到,一旦子类489/190签证获批准后, 其申请员工将不会被捆绑工作于其业务内。

培训和研究(子类402)签证
– 已经在当地生活并在指定的职业技能工作了至少三个月。

由2016年3月15日开始试用’优先级处理’中国公民访问签证

澳大利亚移民部和边境保护局将于明天星期三开始正式试用中国公民旅游签证细类600-旅游或商务资格 “优先级处理服务” 为申请人要求其签证申请优先考虑,目的为使澳大利亚成为一个更具吸引力的旅游目的地。

申请人须付签证费额外AUD $ 1,000以要求使用这优先级服务。

这条新渠道将于2016年3月15日推出, 详细申请细则将于公布后尽快更新。

關於廢除457簽證的壓倒性消息今天在互聯網和論壇上瘋傳。非457簽證的申請人認為他們是安全的。今天下午,移民部公佈了進一步信息,有關改變不僅影響到457簽證申請人,還影響到190,489,186, 407以及剩餘期限457簽證申請人,因為SOL和CSOL技術移民清單將由2017年四月十九日開始由新的職業名單取代,名為中長期戰略技能名單(MLTSSL)和短期技能職業名單(STSOL),部門稱名單將每6個月更新一次。

例如:233111化學工程師只能申請189,485和489簽證,190簽證將不可使用。

457臨時(技能)簽證將被廢除 

總理馬爾科姆·特恩布爾(Malcolm Turnbull)說:「聯邦政府將廢除457簽證,取而代之為兩項新簽證」。

目前的457簽證持有人不會受到這些變化的影響,將引入的兩項新的臨時技術簽證為 – 兩年簽證和更專業的四年“針對更高的技能” 簽證。

特恩布爾先生表示,新制度將明確以“國家利益”為嚴謹,堅決地進行。他評論現時的457簽證計劃是開放式的,因此持有人最終可以留在澳大利亞,因此聯邦政府將提出新的臨時技能簽證而此是短期簽證,目標是暫時提供缺乏之技能,分別是兩年的簽證,及再延期兩年簽證,但最終持有人不會獲得永久居留權。

境內伴侶簽證SC820/801的處理時間顯著增加至16-23個月。優先處理低風險申請人之申請

移民局局長-伴侶簽證 致信關於增加境內伴侶簽證的處理時間。  由於伴侶簽證申請率高﹑境內申請管道增加﹑此簽證有較高的欺詐活動以及該部門的資源限制等原因,大部份的臨時伴侶和永久伴侶簽證的平均處理時間目前為 由SC820提交之日起 或 由SC801 / 100提交之日起計算 增至16至23個月。 該信件亦透露,他們將優先處理低風險申請人,及已提交了完整文件, 能馬上付合批獲該簽證之申請。因此,該局現在不會堅持按照遞交申請之先後時間順序方法去處理申請。這個安排將導致一些後期呈交申請人卻較其他之前申請人優先獲得批獲簽證。

進一步限制在簽證申請中 包括成年的家庭成員在內

您是否知道由2016年11月19日開始, 新修訂的澳洲移民法例 已進一步限制達到23歲的成年家庭成員加入簽證申請中?

法例更改前,主要申請人可以在其簽證申請中 包括他們的子女或親戚在內 包括18歲以上﹑未婚﹑同住及完全或基本上依賴主要申請人所提供的財政支持為生。簡單說,任何年齡超過18歲,甚至50歲者只要付合以上要求的子女或法訂親戚也可以包括在簽證申請內。

法例更改後, 任何子女達到23歲或以上,甚至未曾結婚 並且完全或基本上依賴主要申請人的財政支持為生的,也不能包括在主要申請人的簽證申請內,除非該子女是因為精神或實際身體殘障而無法工作而且只可以 依賴申請人的財政支持為生(別無他人可依賴),。

因此,子女以外的其他親屬,甚至一直在財務上依賴於主申請人者已不能再包括在簽證申請內了。除非是依賴子女之依賴子女例外, 即主申請人的孫子女。 但其父或母及他們自己也同時必須符合以上的年齡限制要求。

這些新修訂限制了一些 以往可透過他們合資格移民澳洲的親屬一同移民澳洲的人。同時, 申請人亦需要考慮在移民時, 一些成年倚賴子女無法一起移民。

*此項更改不用於難民﹑人道主義及保護簽證申請。

最新頒佈: 關於技術移民, 在澳洲完成博士或碩士學位(研究生)申請人能獲得額外五分。

澳洲移民和邊境保護局剛公佈新修訂的一般技術移民“點考”制度, 一般技術移民(GSM)的申請人除可以從現時的教育程度及澳洲學習兩方面獲取分數之外, 若他們同時在澳洲完成博士或碩士學位(研究生)可以額外獲取 5分,如果符合以下要求。

1)已完成至少兩個全學年的博士或碩士(研究)級研究生學位,並
2)在指定的畢業範疇,其中包括科學﹑科技﹑工程,數學或信息及通信技術。

根據這項新措施, 被接受的指定學習範疇包括以下

澳洲護士和助產士鑑定委員會 – 英語考試要求變更
澳大利亞護士和助產士認證委員會(ANMAC)宣布由2016年7月1日起,技能評估對英語語言要求有所變更。

變化將接受和允許多個英語測試結果以作為技能評估要求。

由2016年7月1日起將接受以下的英語測試:

雅思(學術類)
ANMAC將接受在同一個測試或最多兩個測試結果,必須在六個月期間進行。

在同一個測試內,最低總體得分為7分

在測試中的任何部份沒有得分低於6.5

OET
ANMAC將接受在同一個測試或最多兩個測試結果,必須在六個月期間進行。

接受PTE學術英語 – 2016年7月1日生效
申請人必須達到最低總體得分65和每個個何部包括聽力,閱讀,寫作和口語最低分數為65 – 。

從2016年7月1日起, 新的簡化學生簽證框架將會啟動

從以上日期開始, 新的學生簽證框架將會開始,到時有只有兩個學生簽證類別,即子類500(學生)和子類590(學生家長)。

新的的學生簽證框架將刪除並取代目前的學生簽證子類別570,571,572,573,574, 575, 576 和580。

此舉變化之目的是按照澳洲政府於2015年6月16日公佈的未來發展方向中的流暢簽證處理報告,並宣布推出一個簡化學生簽證框架(SSVF),以支持澳洲教育服務部門發展。在SSVF下主要的變化是:
•減少學生簽證類別, 由八類減至只有兩類;和
•為所有國際學生引進簡化的單一移民風險框架。

單一移民風險框架, 將被使用於指導學生在申請學生簽證時, 要提供的財政能力和學生英語語言能力的證據。

北澳 更新州提名技術移民職業清單, 歡迎更多的技術移民

最近 北澳洲Northern Territory更新了州提名職業列表, 63項新職業已經加入提名職業列表上, 為今年七月開始推出的北澳$50億基礎設施項目貸款計劃提前作預備。

聯邦政府已經準備好推出澳大利亞北部基礎設施((NAIF))來管理其$50億貸款計劃,以刺激北部地區的發展。北澳政府為此已經優先開放了其職業技能列表, 增加職業技能要求的數量。州政府將贊助永久州提名技術移民(子類190)和臨時州提名技術移民(子類489)之簽證,總共超過170種職業。

對於已經居住於北澳及持有以下簽證的人,可以申請州提名技術移民:

工作假期(子類417)和(子類462)簽證持有者

– 已經持有簽證不少於六個月,及
– 已居住於北澳和全職工作於相關的職業技能最少三個月, 同時在受聘期間是受薪市場應有薪金,及
– 可以顯示能繼續就業的前景,及
– 簽證獲批後, 打算真正居住和工作在北澳不少於兩年。

臨時技術工作457簽證持有者

– 已經在當地生活及為贊助顧主工作不少於六個月。特殊情況除外。
– 必須有457贊助顧主的函件, 支持其員工的簽證申請,以及顧主他們明白到,一旦子類489/190簽證獲批准後, 其申請員工將不會被捆綁工作於其業務內。

培訓和研究(子類402)簽證

– 已經在當地生活並在指定的職業技能工作了至少三個月。
-必須有402贊助顧主的函件, 支持其員工的簽證申請,以及顧主他們明白到,一旦子類489/190簽證獲批准後, 其申請員工將不會被捆綁工作於其業務內。

臨時研究生(子類485)簽證持有者及畢業於Charles Darwin University北澳校園的學生也可以較優惠地申請北澳州的政府提名簽證。

暫停澳洲首都堪培拉( ACT)2015/16年度 海外申請技術提名移民190簽證

( 2016年3月18日下午4:00 AEST )開始 – 澳大利亞首堪培拉關閉所有境外居民/海外申請技術提名移民190簽證,直到程序在2016年7月1日重新開放。

2016年3月18日下午4點前遞交之申請可繼續排隊順序處理。

請注意:由於2月23日職業清單公佈後收到大量申請,所以目前處理申請時間為3至四個月。

堪培拉居民

堪培拉內居民的申請人則不受此公佈影響。堪培拉居民申請平均處理時間為4週。

NEW TEMPORARY PARENT VISAS

Assistant Immigration Minister of Australia Alex Hawke told SBS News yesterday about two new type of temporary parent visas

The two new temporary parent visas include
1) $5000 for 3-year visa and
2) $10,000 for 5-year visa

Under the new scheme, applicants could seek a three-year visa for $5,000 or a five-year visa for $10,000, with the opportunity of a single renewal for another five years at the same price, therefore $20,000 for a 10-year temporary parent visa.

-Not allow to work
-Require private health insurance
-Children sponsor must be Australian citizens or permanent residents, or “eligible New Zealand citizens
-Not allow to reapply beyond the 10 years and
-Would not have pathway to permanent residency
The new scheme temporary parent visas would help the government limit rising healthcare costs. Mr Hawke also said this new scheme can allow grandparents come to Australia to care for their grandchildren while the parents work.

457 Visa

*Any 457 sponsorship, nomination or visa applications that are NOT listed STSOL or MLTSSL occupation lists and NOT decided by 18th April 2017 will no longer be able to be approved. Refund of DIBP application fees may be available.

*Any new 457 applications lodged from 19 April 2017 onwards will have to have their occupation on the STSOL or MLTSSL occupation lists.

*If you are granted a 457 visa after 18 April 2017 off the STSOL list, it can only be granted for 2 years. There will be one (only) further extension allowed after that for another 2 years. You will not be allowed to apply for a permanent 186/187 visa under that occupation if it is on the STSOL.

*If you are granted a 457 visa after 18 April 2017 off the MLTSSL list, it can be granted for 4 years. You will be able to be apply for a permanent 186/187 visa after 3 years on a 457 visa if that company decides to nominate you.

*From March 2018 the new TSS visa will have replaced the 457 visa. You will need to have 2 years work experience before applying and your occupation will have to be on the STSOL or MLTSSL lists. If you are on the STSOL list you will also have to show you only want to stay in Australia temporarily.

*From March 2018 you need to have your occupation on the MLTSSLoccupation list to apply for company/employer sponsored permanent residence. You will also need to commit to working for the company for 3 years, have an IELTS of 6+ and be under 45 years of age.

Existing permanent visa concessions for regional Australia, such as waiving the nomination fee and providing age exemptions for certain occupations, will be retained. Consideration will be given to expanding the occupations in regional Australia that are exempt from the age requirement.

WHAT ARE THE NEW CHANGES ANNOUNCED FROM DIBP ON 18 APRIL MEAN TO SKILL MIGRATION?

Subclass 189 Skilled Independent Visa
You can only nominate an occupation that is on the MLTSSL occupation list. If you find your nominated occupation no longer on the MLTSSL occupation list, you cannot apply for this visa anymore.

Subclass 190 Skilled Nominated Visa
You can nominate an occupation that is on the lists of MLTSSL, STSOL or State Occupation. However, some occupations imposed with a restriction limits the applicant apply for Subclass 190, such as Project Builder, Chemical Engineer, Production Manager etc. 40 occupations have imposed with this limitation. Besides these, State governments have announced they will amend their skill nomination list to echo the changes, further announcement will be coming soon.

Subclass 489 Skilled Regional (Provisional) visa
Family sponsored stream
You can only nominate an occupation that is on the list of MLTSSL. If you find your nominated occupation no longer on the MLTSSL occupation list, you cannot apply for this visa anymore.

State nominated stream
You can nominate an occupation that is on the list of MLTSSL or STSOL or on the list of State Occupation. However, some occupations imposed with a restriction limits the applicant to apply for Subclass 489(State nominated stream), such as Project Builder, Chemical Engineer, etc. 16 occupations have imposed with this limitation.
Besides these, State governments have announced they will amend their skill nomination list to respond the changes, further announcement will be coming.

What will happen if you have lodged EOI for an occupation which has been removed from the new occupation lists. Likely, you will no longer receive the invitation to apply.

Subclass 485 Temporary Graduate visa
Graduate Work stream
You can only nominate an occupation that is on the list of MLTSSL. If you find your nominated occupation no longer on the MLTSSL occupation list, you cannot apply for this visa anymore.

Besides, due to the new changes require the applicant for SC457 and SC186 to have at least 2 year and 3 year full-time work experience respectively. Most student graduates will not be eligible for these two visas that mean they will not be able to gain Australian work experience to top up their points for general skill visa.

SCRAPPING THE SC457 IS ONLY AN ENTREE, 200 OCCUPATIONS REMOVED FROM SKILLED MIGRATION LIST AFFECTING SC190 SKILLED NOMINATED VISA AND 489 SKILLED REGIONAL(PROVISIONAL)VISA

Overwhelming news about the abolishment of SC457 are spreading in the internet and forums today. People who are not intended to apply for SC457 thought they are safe. In the late afternoon of today, the DIBP put out more information about the changes revealing that not only affect the SC457 applicants but also affect SC190, SC489, SC186, 407 and the remaining period for SC457 visa applications because the SOL and CSOL will be replaced by the new occupation list namely Medium and Long-term Strategic Skills List (MLTSSL) and Short-term Skilled Occupation List(STSOL) respectively effective on 19 April 2017 and the Department says that the list will be renewed in every 6 months.

For example: 233111 Chemical Engineer will only be available to SC189, 485 and 489 applications, SC190 will not be available.

 

SUBCLASS 457 TEMPORARY WORK (SKILLED) VISA WILL BE ABOLISHED

The Federal Government will abolish the 457 visa and replace it with two new visas, Prime Minister Malcolm Turnbull says.

Current 457 visa holders will not be affected by the changes, which will see the introduction of two new temporary skills visas — a two-year visa and a more specialised one for four years “targeted at higher skills”.

Mr Turnbull said the new system would be “manifestly, rigorously, resolutely conducted in the national interest” and he commented about the existing 457 visa program is open-ended resulting the holders can stay in Australia eventually therefore the Federal Government will propose the new temporary skills visas that will be a short-term visas to target temporary shortage of skill, there will be a two-year visa, with the options of two years, but there won’t be permanent residency outcomes at the end of that.

QUEENSLAND TEMPORARILY SUSPENDS QUEENSLAND SKILLED VISA NOMINATION FOR SUBCLASS 190 & 489 DUE TO HAVING REACHED CEILING NUMBERS

An announcement from Queensland on 10 April that they have temporarily suspended the acceptance of all applications for Queensland Skilled Visa Nominations under the State Nominated scheme subclass 190 and 489, due to having reached the DIBP allocated ceiling.  This is the third States announced the suspension of skilled nomination in this year followed ACT and Western Australia. It means the applications to skilled nominated visa will become even harder.

How does the suspension affect current applicants?

If you currently have a paid application with Queensland that has not been finalised, you can either choose to stay in the queue to be processed once applications have been reopened or request a refund and your application will be withdrawn.

If you haves submitted an EOI that has not been considered, your EOI is no longer valid and you will be required to resubmit an EOI once the application process has been reopened.

PROCESSING TIME FOR ONSHORE PARTNER SC820/801 VISA SIGNIFICANTLY INCREASE TO 16-23 MONTHS.  PROCESSING PRIORITY GIVES TO LOW-RISK APPLICANTS

A letter from the Director of Onshore Partner Migration, DIBP states that due to the reasons of high application rates, growing pipelines onshore and significant fraudulent activity as well as resourcing restrictions of the Department, average processing times for most Temporary Partner and Permanent applications are currently between 16-23 months from date of lodgement of SC820 and from date of eligibility SC801/100.

The Department revealed that they will give priority to low-risk applicants and those regarded by DIBP as fully front-end loaded with documentation that immediately satisfies Partner criteria. As a result, the usual chronological method of assessing applicants by month of lodgement will not be upheld now and this will result some of applicants receive decisions ahead of others who lodged many months prior.

SOUTH AUSTRALIA HAVE ANNOUNCED INCREASE THE REQUIREMENT FOR HIGH POINTS FOR SKILLED NOMINATION.

From 19 April 2017, the requirement for high points nomination will increase from 80 to 85 points.

This changes is in response to the overall quota being achieved under the existing 80 points requirement.

This change will not affect applications lodged prior to this time but applications for high points nomination received after this time will be refused if they do not meet the 85 points requirement.

VISA AND CITIZENSHIP PROCESSING TIME AVAILABLE ONLINE​​

Global visa and citizenship processing times will be available online for the first time from 13 March 2017.

As part of the DIBP’s ongoing efforts to improve applicants information, the publishing of current visa and citizenship processing times will give applicants more meaningful data about the visa or citizenship product of their choice.

The latest processing times will replace the previously published service standards to give applicant a better idea of how long it is taking to process a particular visa subclass, stream, or citizenship application.

Processing times will be updated monthly to reflect current caseloads and processing pressures, and will be available for most visa subclasses and citizenship application types. The Department does not publish processing times for some subclasses, as they are closed to new entrants, or capped and queued.

To ensure that the application falls within the published processing times, applicant must lodge a complete application. The application will be assessed on a case-by-case basis, and actual processing times can vary due to individual circumstances. (Information extracts from the News of DIBP’s website)

AN ADDITIONAL PATHWAY TO AUSTRALIAN PERMANENT RESIDENCE FOR NEW ZEALANDER HOLDING SPECIAL CATEGORY VISA (SCV) HOLDERS

​​In acknowledgment of the special bilateral relationship, the Australian Government will provide an additional pathway to permanent residence, and therefore citizenship, for New Zealand Special Category visa (SCV) holders who arrived after 26 February 2001, who have lived in Australia for the last five years and shown a commitment and contribution to Australia.

This additional visa pathway will be available from 1 JULY 2017, for New Zealand citizens who arrived post 26 February 2001, but on or before, the date of the announcement, 19 February 2016.

How this Pathway will Work
The pathway will be made available within the Skilled Independent category of the General Skilled Migration (GSM) stream of Australia’s annual Migration Programme.

This pathway will allow SCV holders who have been living in Australia for the past five years, and have earned income at or above the Temporary Skilled Migration Income Threshold (TSMIT)(It is curr​​ently set at AUD53,900) as evidenced by their Australian Taxation Office Notice of Assessment throughout their qualifying residence period, to apply for permanent residency and thereafter citizenship.​

Exemptions to the Income Test
Limited exemptions to the income test requirement will be considered for particularly vulnerable New Zealand citizens.

Estimated Number of Eligible Applications
Approximately 60,000 – 70,000 of the 140,000 post 2001 SCV holders who have been in Australia for at least five years are expected to be eligible.​

FURTHER STRENGTHEN LIMITATION TO INCLUDE ADULT FAMILY MEMBER IN VISA APPLICATION

Did you know the new amendments to Migration Regulations limit the adult dependent at 23 to be included in a visa application since 19 November 2016?

Before the changed, the primary visa applicant may in their application, include their children or relative who are over 18, not married, live in the same household and wholly or substantially reliant on the primary applicant for financial support. In short, any ages over 18, even 50 years old can be included.

The change now set the age limit up to 22 years old to any children of the primary applicant to be included in visa application. Therefore, any children is at 23 or above, even has not married and substantially reliant on the primary applicant for financial support CANNOT be included in visa application, unless the children are wholly or substantially reliant for financial support because incapacitated for work due to mental or physical disability.

Hence, other relatives NO LONGER can be included in the visa application like before even financially reliant on the primary applicant except the children of the dependent children who also satisfy the age limit requirement can be included.

These new amendments limit people who want to migrate to Australia base on the qualification of their relatives are no longer available. Families who want to migrate to Australia, before lodging their visa application, should consider that their adult dependents may not be able to migrate to Australia with them.

*This change does not apply to refugee, humanitarian and protection visa application.

TEMPORARY CLOSURE OF ICT OCCUPATIONS FOR SKILLED APPLICANTS – VICTORIA

Due to a large volume of skilled visa nomination applications received, applications for Information and Communications Technology (ICT) occupations will not be accepted from 11 November 2016 to 6 March 2017

The closure will be for a period of four months, however further updates will be provided should this be extended.

The occupations affected by the temporary closure are:

Applications for all other occupations eligible for Victorian Government visa nomination remain open.

Note: Applicants applying under the streamlined PhD and 457 are not affected by this closure and may apply with these ICT occupations during this time.

ACT – SUBCLASS 190 NOMINATIONS CLOSED FOR OVERSEAS APPLICANTS

You may not be fast enough to lodge the application of subclass 190 with the ACT who just announced the new ACT occupation list early of this month, the ACT Government has now advised that the Skilled Nomination Subclass 190 program has been closed to overseas applicants until 2017. The closure is effective immediately. Applicants living overseas cannot commence an application for ACT nomination until the program reopens next year.

Applications that have been lodged and paid for will continue to be processed. The application must be complete with all supporting documents attached. Additional documentation will not be accepted after lodgement.

This closure does not affect Canberra based applicants who are still able to lodge applications if they meet the current required criteria.

AUTOMATIC ACT NOMINATION FOR PHD GRADUATES

The ACT announced on 8th September that an automatic ACT Nomination will be provided to the PHD GRADUATES starting from 1 NOVEMBER 2016.

The ACT will offer streamlined, automatic nomination of a Skilled Migration Visa to international students who complete/d a PhD at an ACT university within the last two years.

It is expected that the following nomination processes will be implemented:

• Simplified online application for ACT nomination (with minimal supporting documentation) capturing personal contact and PhD course details;
• No requirement to meet the standard nomination criteria e.g. employability and commitment;
• Fee free application (the $300 service fee will be waived); and
• Priority processing (within one week) of the application for ACT nomination

Once ACT nomination is confirmed on SkillSelect, the Department of Immigration and Border Protection will simultaneously issue the visa invitation to apply for a Skilled Nominated (subclass 190).

EXTRA POINTS AWARD TO APPLICANTS WHO HAVE COMPLETED DOCTORAL OR MASTERS BY RESARCH IN AUSTRALIA.

Department of Immigration and Border Protection just announced a new amendment to the “points test” system for the purpose of General Skilled Migration(GSM). Applicants of GSM who can claim extra 5 points on top of their points getting from education, if they meet the below requirements.

1) have completed at least two full academic years of post-graduate studies at doctoral or masters (research) level, and
2) in specified fields, which may include science, technology, engineering, mathematics, or information and communication technology.

Specified Field of education qualifications are proposed to be accepted under this new measure include the following at the moment

GRANTING OF PARENT AND OTHER FAMILY VISAS IN 2016/2017 FINANCIAL YEAR

The maximum number of visa that may be granted in the 2016/2017 financial year for the following visa classes:

– Non contributory Parent (Migrant) and Aged Parent (Residence)- visas at 1550; and
– Other Family (Migrant) and Other Family (Residence) visas at 520

These figures include grants to New Zealand citizens that are not otherwise included in the Migration Programme.

THE NEW ACT OCCUPATION LIST

The ACT Government has released a new ACT Occupation List effective on 1 September 2016.

A summary of the list provides the following information:

-The skills need has eased for restaurant managers, management consultants, solicitors and financial advisers. These occupations are now closed.

-The demand for skills within corporate management, HR and the creative / design sector is increasing. Occupations within these sectors have now opened.

-The ‘open’ status of the following occupations remains unchanged indicating a continual high demand for civil engineers, general practitioners, retail pharmacists, early childhood teachers, architects, medical imaging professionals, registered nurses, counsellors, mechanics, psychologists and real estate professionals.

NEW QUEENSLAND BUSINESS CRITERIA FOR THE BUSINESS, INNOVATION AND INVESTMENT PROGRAM AND A NEW QUEENSLAND SKILLED OCCUPATION LIST HAS BEEN APPROVED

Business and Skilled Migration Queensland (BSMQ) is pleased to announce that new Queensland Business Criteria for the Business, Innovation and Investment Program (BIIP) and a new Queensland Skilled Occupation List (QSOL) has been approved by the Queensland Government. These changes will come into effect from Monday 25 July 2016.

The headline changes include:

Subclass 132 Business Talent (Significant Business History Stream)

Net Business and Personal Assets of AUD$1.5 million to be transferred to Queensland within 2 years after visa is granted including:

– minimum AUD$1million investment in a business

– minimum AUD$500,000 settlement costs

– must reside in Queensland

Subclass 188 Business Innovation and Investment

A. Innovation Stream: Net Business and Personal Assets of AUD$800,000 to be transferred to Queensland within 2 years after visa is granted including:

– minimum AUD$200,000 investment in a business

– must reside in Queensland

B. Investor Stream:

– Existing criteria remains the same

– must reside in Queensland

C. Significant Investor Stream (SIV):

– current Austrade Complying Investment Framework

– commitment to Queensland

Queensland Skilled Occupation List (QSOL)

The new QSOL will be released and come into effect as of Monday 25 July 2016 and made available on the BSMQ website.

BSMQ will suspend processing Expressions of Interest (EOI) Thursday 14 July until Friday 22 July 2016 in order to update the relevant fact sheets and application forms, and the new QSOL. From Monday 25 July 2016, BSMQ will commence processing EOI’s under the newly approved business criteria & QSOL list.

Please note that applicants can still lodge an EOI in the suspended period, however it will not be reviewed until processing has recommenced.

ENGINEERS AUSTRALIA – CHINA SIGNS TO WASHINGTON ACCORD

Engineers Australia have announced that China, represented by the Chinese Association for Science and Technology (CAST) became full signatory of the Washington accord on the 2nd June 2016.

Holders of Chinese accredited qualifications completed in or after 2016 will be eligible for Membership of Engineers Australia as well as Migration Skills Assessment via the accredited qualifications pathways.

Whilst CAST is the signatory of the Washington Accord, the list of accredited courses is held on the website of the Chinese Engineering Education Accreditation Association, a body affiliated to CAST.

For the qualification to be recognised as accredited under the Washington Accord, it needs to be listed on the list of accredited qualifications and be completed in or after 2016.

AUSTRALIAN NURSING AND MIDWIFERY ACCREDITATION COUNCIL -ENGLISH LANGUAGE TEST CHANGES

The Australian Nursing and Midwifery Accreditation Council(ANMAC) has announced changes to English language requirements for skills assessments from 1 July 2016.

The changes will accept an increased testing providers and allow the results from more than one test to be used within specific guidelines.

The following tests and attempts will be accepted from 1 July 2016:

IELTS (Academic module)
ANMAC will accept test results from one test sitting OR a maximum of two test sittings, in a six-month period only if the applicant achieves:

a) a minimum overall score of 7 in each sitting
AND
b) no score in any component of the test is below 6.5

OET
ANMAC will accept test results from one test sitting OR a maximum of two test sittings, in a six-month period only if the applicant:

a) is tested in all four components in each sitting
AND
b) no score in any component of the test is below C

PTE ACADEMIC Accepted – effective 1 July 2016
Applicants must achieve a minimum overall score of 65 AND a minimum score of 65 in each of the four communicative skills – listening, reading, writing and speaking.

ANMAC will accept test results from one test sitting OR a maximum of two test sittings, in a six-month period only if the applicant achieves:

a) a minimum overall score of 65 in each sitting
AND
b) no score in any of the four communicative skills is below 58

TOEFL iBT Accepted – effective 1 July 2016
Applicants must achieve a minimum total score of 94 AND the following minimum score in each section of the test: 24 listening, 24 reading, 27 writing & 23 speaking

ANMAC will accept test results from one test sitting, OR a maximum of two test sittings in a six-month period only if the applicant achieves:

a) a minimum total score of 94 in each sitting AND
b) no score in any of the sections is below:
– 20 listening
– 19 reading
– 24 writing
– 20 speaking

ANMAC will not be offering waivers/text exemptions for ELP. Internationally qualified nurses and midwives seeking a waiver/test exemption are able to apply for a modified skills assessment after having their ELP assessed by AHPRA/NMBA for registration. Modified skills assessments do not require the submission of English language test results.

A NEW SKILLED OCCUPATION LIST AND 2016-2017 OCCUPATION CEILING

On 1 July 2016, a new SOL will be introduced with a number of changes to the occupations. If you intend to apply on or after 1 July 2016 for an Independent or Family Sponsored Points Tested visa or a Temporary Graduate (subclass 485) – Graduate Work Stream visa, you need to make sure your occupation is listed on the new SOL. If you have lodged a valid application before 1 July 2016, your application will not be affected by these changes.

Occupations being added to the SOL from 1 July 2016 are:
-Orthotist or Prosthetist (ANZSCO 251912)
-Audiologist (ANZSCO 252711).

Occupations being removed from the SOL from 1 July 2016 are:
-Mining Engineer (Excluding Petroleum) (ANZSCO 233611)
-Petroleum Engineer (ANZSCO 233612)
-Metallurgist (ANZSCO 234912)
-Environmental Health Officer (ANZSCO 251311)
-Occupational Health and Safety Adviser (ANZSCO 251312)
-Dental Hygienist (ANZSCO 411211)
-Dental Prosthetist (ANZSCO 411212)
-Dental Technician (ANZSCO 411213)
-Dental Therapist (ANZSCO 411214).

The review of the SOL has not impacted the composition of the Consolidated Sponsored Occupations List (CSOL). Occupations currently listed on the CSOL will continue to be listed from 1 July 2016.
Besides, the occupation ceiling levels for the 2016-17 programme on the SOL has also released. The significant changes in the below occupations.

ISRAEL HAS BEEN ADDED IN THE ELIGIBLE COUNTRY FOR 462 WORK AND HOLIDAY AND SINGAPORE WILL BE ADDED SOON

Now, people between 18 to 30 from Israel can apply for work and holiday 462, other requirements include
*have secondary school qualifications; and
*have completed military service or are legally exempt from military service.

A holder of a state of Israel passport does not need to provide evidence of government support for grant of this visa; and

for making a valid application, the application should send to Australian Embassy in Israel.

For Singapore, it will be added to the list of Work and Holiday Subclass 462 visa eligible countries soon.

The Minister of Australian Immigration and Border Protection also announced that the option of a long validity, multiple-entry visitor visa for Singaporean nationals to visit Australia will also be introduced.

THE NEW SIMPLIFIED STUDENT VISA FRAMEWORK WILL START FROM 1 JULY 2016

From 1 July 2016, the new Student visa framework will commence and there will be only two Student visa subclasses namely Subclass 500 (Student) and Subclass 590 (Student Guardian).

The new implementation will remove and supersede the current Student visa subclasses 570, 571, 572, 573, 574, 575, 576 and 580.
The intention of changes are in accordance to the Australian Government released the Future directions for streamlined visa processing report on 16 June 2015 and announced the introduction of a simplified student visa framework (SSVF) to support Australia’s education services sector. Key changes under the SSVF are:
• A reduction in the number of student visa subclasses from eight to two; and
• The introduction of a simplified single immigration risk framework for all international students.

The single immigration risk framework will be used to guide the evidence of financial capacity and English language proficiency that a student is required to provide with their visa application.

NORTHERN TERRITORY (NT) NEW SKILLED NOMINATION OCCUPATION LIST WELCOME MORE MIGRANTS

A recent updated on NT state nomination occupation list with 63 new occupations have been added ahead of the launch the $5 billion infrastructure projects’ loan scheme set for launch in July this year.

As the Federal Government gets ready to launch the Northern Australia Infrastructure Facility (NAIF), which will administer its $5 billion loan scheme to stimulate northern development, the NT state government has opened up its skills list taking the number of occupations that the state government will sponsor for permanent (sc190) and temporary (sc489) visas to over 170 occupations.

For the below visa holders who have already residing in Northern Territory can apply for NT state nomination if

For Working Holiday (Subclass 417) and Work and Holiday (Subclass 462) visa holders

-held their visa for no less than six (6) months, and
-lived and worked full time in the NT in the nominated skilled occupation or a closely related skilled occupation for a period of three (3) months immediately prior to applying for NT sponsorship and been paid at the market rate for that occupation in the NT, and
-can show ongoing employment prospects, and
-demonstrate a genuine intention to live and work in the NT for no less than two (2) years after their visa is granted.

Temporary Work (Skilled) (Subclass 457) visa holders

-Must be living and working for a Subclass 457 sponsoring business in the NT for at least six (6) months prior to applying for nomination. Exceptional consideration may apply.
-Must have a letter of support from the current Subclass 457 sponsoring business stating that they support their employee’s visa application and they understand that the nominee will not be tied to the business once the Subclass 489 / Subclass 190 visa is granted.

Training and Research (Subclass 402) visa

-Must be living in the Northern Territory and working in your nominated skilled occupation for a minimum of three (3) months immediately prior to applying for nomination.
-Must have a letter of support from the current Subclass 402 sponsoring business stating that they support their employee’s visa application and they understand that the nominee will not be tied to the business once the Subclass 489 / Subclass 190 visa is granted.

Temporary Graduate (Subclass 485) visa holders and Graudates from the campus of Charles Darwin University in NT can also apply for NT State nomination with concessional requirements.

ACT SKILLED NOMINATION PROGRAM CLOSED TO OVERSEAS APPLICANTS

IMPORTANT ANNOUNCEMENT
SKILLED NOMINATED (SUBCLASS 190) VISA – CLOSURE OF ACT NOMINATION PROGRAM TO OVERSEAS APPLICANTS FOR 2015/16

The Australian Capital Territory announced that program targets for ACT nomination of a Skilled Nominated (subclass 190) visa have been met for the 2015/16 financial year.

Effective 18 March 2016 at 4:00pm AEST, applications for ACT nomination from overseas residents will not be accepted. If you are living overseas you are not able to apply for ACT nomination of a Skilled Nominated (subclass 190) visa until the program reopens in July 2016.

Applications for ACT nomination already submitted before 4:00pm 18 March 2016 will be processed in queue order.

CANBERRA RESIDENTS

This action does not affect Canberra-based applicants. If you are living in Canberra and working in a skilled occupation, the program is open. You are still able to apply for ACT nomination of the Skilled Nominated (subclass 190) visa if you meet the current nomination criteria for Canberra residents.

Trial of Priority Processing of Visitor visa for Chinese citizens on 15 March 2016

The Department of Immigration and Border Protection is trialling the priority service for eligible Chinese nationals for visitor visa subclass 600 in the Tourist or Business streams to request priority consideration of their visa application and is amimed at making Australia a more attractive visitor destination.

The priority service is available for an additional fee of AUD $1,000 in addition to the usual VAC.

This trail will be launched on 15 March 2016. Details will be updated soon.

Hungary citizen will be allowed to apply for Work and Holiday Visa.

The Minister for Immigration and Border Protection has announced on 24 February 2016 that a reciprocal work and holiday visa agreement has been signed between Hungary and Australia.

The agreement will allow 18 to 30 years old from both countries to experience each other’s culture.

The Work and Holiday visa requires applicants to have the support of their government, hold or be studying towards tertiary qualifications and speak functional English.

It will be some months before the administrative requirements for the visa are finalised and it becomes available for applications.

The arrangement will be capped at 200 places each year.

Currently, the eligible passport holders for applying visa 462 Work and Holiday include:
